San Francisco prosecutors Monday charged an illegal immigrant -- with a lengthy criminal record and deported five times -- with the murder of a young woman at a popular city pier.
Francisco Sanchez, a 45-year-old repeat drug offender released from jail April 15 after law enforcement officials declined to prosecute him, was expected to be arraigned Tuesday in the killing of Kathryn Steinle, 32.
The charge came hours after federal immigration officials fired back at San Francisco for putting Sanchez back on the street, saying "this terrible tragedy" could have been prevented if they had been notified of the suspect's release.
Sanchez, a Mexican national, had been in the custody of the San Francisco Sheriff's Department on a decade-old drug charge when he was released.
In a detailed statement released Monday, Immigration and Customs Enforcement (ICE) said that at the time it had turned over Sanchez to local law enforcement, it also had requested that they be kept apprised of any changes in his status -- and they weren't.
"We're not asking local law enforcement to do our job," ICE spokeswoman Gillian Christensen said in the statement. "All we're asking is that they notify us when a serious foreign national criminal offender is being released to the street so we can arrange to take custody."
While saying the agency understands local law enforcement's "reticence" on the issue, Christensen said the bottom line is that if San Francisco authorities "had merely NOTIFIED ICE that they were about to release this individual into the community, ICE could have taken custody of him and had him removed from the country -- thus preventing this terrible tragedy."
The city did not notify ICE, she said, and, "As a result, an individual with a lengthy criminal history, who is now the suspect in a tragic murder case, was released onto the street rather than being turned over to ICE for deportation."
The circumstances surrounding Sanchez have reignited the debate over so-called sanctuary city policies.
As a sanctuary city, San Francisco like many other California cities often does not turn over illegal immigrants to federal officials.
However, Sanchez has a lengthy rap sheet.
According to ICE, he had been deported five times, most recently in 2009, and his record included seven prior felony convictions. ICE briefly had him in their custody after he completed a prison sentence in California, but turned him over to San Francisco on an outstanding warrant for a felony drug charge in late March. They lodged what's known as an "immigration detainer," which was not honored.
Freya Horne, an attorney for the San Francisco Sheriff's Department, told the Associated Press on Friday they had no authority to hold him.
Horne said federal detention orders are not a "legal basis" to hold someone, so Sanchez was released April 15. Horne said the city does not turn over people who are in the country illegally unless there's an active warrant for their arrest.
But a law enforcement official familiar with the issue told FoxNews.com there are "literally no jurisdictions" in the country where ICE gets a judicial warrant to request that local law enforcement notify them of a pending release.
The official called this claim by San Francisco "ridiculous."
Meanwhile, Sanchez reportedly has admitted in a jailhouse interview that he shot Steinle.
He told KGO-TV Sunday in a mix of Spanish and English that he found a gun wrapped inside a shirt while he was sitting on a bench at the pier and smoking a cigarette.
"So I picked it up and ... it started to fire on its own," Sanchez said, adding that he heard three shots go off.
Steinle was gunned down while out for an evening stroll at Pier 14 with her father and a family friend on Wednesday. Police said witnesses heard no argument or dispute before the shooting, suggesting it was a random attack.
A source familiar with the investigation told the San Francisco Chronicle that Sanchez said he was at the popular pier to shoot at sea lions, and discarded the firearm after realizing he had shot Steinle.

A thug who murdered a teenager by stabbing him to death when he tried to save his friend in a street attack has been jailed for life.
Evil Richard Johnson, 24, knifed 19-year-old boxing star Joshua Bradley in the heart with a ten-inch hunting knife during a vicious brawl.
A jury found Johnson guilty by majority verdict of murder following a trial at Nottingham Crown Court.
Co-accused Zaiem Zulqurnain, 20, of Aspley, Nottinghamshire, was cleared of the murder and a second charge of violent disorder.
Joshua, a former boxer who represented England, was stabbed in the chest after a fight broke out in Thurland Street in Nottingham at 4am on February 8 this year.
Johnson, of Hyson Green, Nottingham, was told he would serve at least 25 years behind bars before being eligible for parole,
Judge Gregory Dickinson said: 'This is an illustration of why Parliament has specified the starting point for those who commit murder using a knife taken to the scene, intending to have it available to be used as a weapon.
'Joshua Bradley was a much-loved son, brother, nephew and friend.
'These people have, I fear many others have too, suffered a devastating loss.
'He would still be alive, but for the fact when you went out that night you took with you a knife and you were ready and willing to use it.'
Joshua was killed when he went to the aid of his pal Carl Henry who was attacked by a group of men who knocked him unconscious when they kicked him in the head.
The brawl was caught on CCTV and showed Joshua defending Mr Henry and then 'crashing to the pavement' after being stabbed through the heart by Johnson.

Earlier, witnesses had heard Johnson claiming he had got his 'ting' on him, referring to the knife tucked into the waistband of his jeans.
Johnson showed no emotion as the verdict was read out and the court was told he had a previous conviction for causing grievous bodily harm.
Joshua's father Darren Bradley, of Bilborough, Notts., said: 'I feel I've got justice for my son, Josh.

'I'm also pleased that the starting point for the sentence was 25 years - anything more than that would have been a bonus.
'But no amount of years can ever be enough. It was one of the most cowardly acts, unprovoked and totally unnecessary.'
Bradley began boxing at seven, was a Nottinghamshire and Lincolnshire youth champion, and won the National Schoolboys Golden Gloves Award.

Clifton Lamar Williams was convicted of killing Cecelia Schneider, who was found by firefighters as they responded to a call about smoke coming from her home in Tyler, about 85 miles east of Dallas, in July 2005.
Investigators later determined she had been beaten and stabbed before her body and her bed were set on fire.

If the death sentence is carried out, Williams, 31, would be the 10th inmate to receive a lethal injection this year in Texas.
The state carries out the death penalty more than any other state, and has at least seven other executions scheduled in the coming months.
The U.S. Supreme Court refused in April to review Williams' case. But late Wednesday, defense attorney James Huggler asked Texas courts for at least a 60-day delay after the Texas Attorney General's Office disclosed that two witnesses at Williams' 2006 trial used incorrect statistics provided by the FBI when testifying about population and DNA probabilities.
Huggler said what wasn't clear was what effect the errors had on their analysis.
The revised figures 'changed only slightly' from the original calculations and remain overwhelmingly against any claim that Williams is innocent, Smith County District Attorney Matt Bingham said in response to the filings.
'In this case, there is nothing extraordinary or compelling that requires reconsideration,' he said.
Williams' lawyers had argued unsuccessfully in earlier appeals that his legal help at his trial was deficient. They also said Williams, who dropped out of school in the 12th grade, was mentally impaired and therefore ineligible for the death penalty.
Prosecutors said Williams broke into Schneider's home to get money to buy cocaine. Her missing car was found later that day, wrecked and abandoned. Williams, then 21, was arrested about a week later.
'His DNA and fingerprints were found in the victim's vehicle,' Melvin Thompson, Williams' lead trial attorney, recalled Wednesday. 'They had some significant evidence.'
He said he didn't concede Williams' guilt but the 'biggest objective in a capital case is to save the offender's life.'
'It was frustrating, very frustrating,' he said of the outcome. 'I'm vehemently opposed to the death penalty. ... It's just vengeful killing.'
Williams had been dating a woman who lived a few doors away from Schneider's home and had been seen in the neighborhood.
Investigators said Williams led police to a pond where Schneider's purse that had contained about $40 was found, along with a knife from her kitchen that investigators believe was used to stab her.
During the trial, a pathologist testified that Schneider was stabbed four times, including in her heart and lungs, and was beaten and may have been strangled.
According to trial testimony, Williams told a psychiatrist he began smoking marijuana at age 15, started lacing it with embalming fluid, then moved on to cocaine by the time he was 17.
Defense attorneys told jurors at the trial that Williams became known on the streets as 'Crazy C' after a stint in a mental health rehabilitation center.
Some death penalty states have had difficulties obtaining drugs for lethal injections, but Texas Department of Criminal Justice officials say they have enough pentobarbital, a powerful sedative, to accommodate all the scheduled punishments. They have refused to identify the drug provider.

Richard Dillman, a 28 year old, was shot twice in South Bend, IN while sitting in his truck. He had entered a mostly black residential area to help a female friend fix her car.
He had a Confederate flag on his truck. Three young black males, on a street corner, began screaming racial abuse at Dillman. Their insults included remarks about the Confederate flag. Dillman may have yelled something back.
One of the black males produced a handgun and opened fire as the victim drove away. The three black males then got into a car and fled. Dillman is expected to survive.
Some initial media reports included false details blaming Dillman for provoking the shooting. These false details included claims that Dillman was on foot and initiated a confrontation with a group of black males. One report alleged Dillman menaced a group of black males with a handgun. Another report claimed that Dillman menaced the group of black males with his truck. These claims were based on second hand hearsay and not eyewitness accounts.
Statements by police and actual eyewitnesses have debunk many claims falsely reported by some media outlet. The false hearsay accounts could indicate that some residents of the neighborhood were trying to protect the perpetrators. It suggests that some residents of the neighborhood harbor the same racial hatred and sympathize with the shooter. This is very disturbing.
No matter how you feel about the Confederate flag, it is definitely no justification to try to murder someone.

No matter how you feel about the Confederate flag, it is definitely no justification to try to murder someone.
