"CHICO, Calif. - The Chico State employee who was arrested for making violent online threats was appointed a public defender in court today.

Butte County District Attorney Mike Ramsey told Action News Now the judge kept the no bail hold order in place, and he will continue arraignment on Thursday at 1:30 p.m.

Ramsey said between May 16-23 Thao made multiple violent comments on YouTube video posts by TV news stations.

These were particularly TV stations in places where there have been mass shootings in the past month - Buffalo, NY, Orange County, CA and Uvalde, TX.

Google notified the FBI about the violent comments Thao made. This led to Thao's arrest on Thursday, May 26. but Ramsey said there was no federal offense that fit the facts they have.

"What they needed was someone who was making a specific threat to a specific person or location," said Ramsey. "None of these were that specific. They were obviously very concerning."

During a search of Thao’s home, Ramsey said firearms and ammunition were found.

Thao had the hate crime charge read against him in the courtroom this afternoon. If convicted, he would face up to one year behind bars since a hate crime is categorized as a misdemeanor.

“If he is proven guilty of the charge we have against him, he would also have a 10 year prohibition of owning firearms under California law," said Ramsey.

Ramsey said the most concerning statement Thao made online read: "Chinese need to commit mass shootings against America for xenophobia and betrayal. Come on my Chinese folks, white graduating is open season for y'all.”

This comment was made on May 19 just before many graduations, and his own at Chico State where he walked on May 23.

"It's shocking to know there's someone on campus that works here and went to school here that had a thing against certain races," said pest control specialist Brian Cross at Chico State. "You just never know who the person really is."

Action News Now spoke with some people who worked alongside Thao on the custodial team. They said he was a nice guy and they could never have imagined him making these types of comments.

Ramsey added Thao has a minor criminal history for a Fish and Game violation and for reckless driving while under the influence.

“Could something have happened? We cannot say for sure," said Ramsey."
